Timeless Women

1. By submitting an entry to the Timeless Moments Gallery, participants are deemed to have read, understood and agree to be bound by these Terms and Conditions.
2. This promotion is open to all persons aged 18 or over.
3. By submitting an entry to the Timeless Moments Gallery, participants confirm either they, their mother, or their daughter has been diagnosed with osteoporosis.
4. By submitting an entry to the Timeless Moments Gallery, participants confirm they own all the rights to the content of the photos, and give permission to Novartis to display the images and words and use them as allowed by these Terms and Conditions.
5. To submit an entry to the Timeless Moments Gallery, either:
   1. visit www.fortimelesswomen.com. Create a submission by filling in your details in the ‘Submit Your Moment’ form, uploading your photo directly onto the Timeless Women website, inserting a message describing your Timeless Moment to accompany the photo; or
   2. visit www.fortimelesswomen.com. Download, print and complete the submission form, attach your photo and send to: Timeless Moments Gallery, c/o Edelman, Floor 3, Southside, 105 Victoria Street, London SW1E 6QT
6. Details of the participants will be logged by Edelman upon receipt. Edelman reserves the right to exclude entries which contain unsuitable content, including but not limited to mentions of specific osteoporosis treatments and language deemed by Edelman to be unacceptable.
7. A participant can have their personal details, photo and explanation removed from the Timeless Moments Gallery at any time by contacting info@fortimelesswomen.com. Once the request is received the photo will be removed at the earliest opportunity and in any case, the Timeless Women team will try to do so within 72 hours. Should a participant decide that they wish for their photo to again be displayed in the Timeless Moments Gallery, they will have to resubmit it.
8. No responsibility will be accepted by Novartis or its agents for lost, illegible, incomplete or non-compliant submissions in any way, or submissions not received by post or submissions which were not registered as having been submitted.
9. No responsibility will be accepted by Novartis or its agents for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, completed or delayed computer transmissions which affect participants’ ability to submit their form to the Timeless Moments Gallery.
10. The submission period starts on Monday 12th October, 2009 and closes on Friday 29th January, 2010, by which time all entries must have been received (‘the Submission Period’).
11. Multiple submissions are permitted throughout the Submission Period.
12. If there is any reason to believe that there has been a breach of the Terms and Conditions or incorrect, illegible, fraudulent or other invalid or improper photos or information have been provided, or for any other reason, Novartis may at its sole discretion refuse to process a submission.
13. Novartis will own and have the right to use exclusively all rights in or relate to any submissions in any way that Novartis sees fit for a perpetual period. Participants and persons displayed will not be paid.
14. Novartis reserves the right to amend, alter or withdraw the Timeless Moments Gallery as it determines necessary.
15. Novartis will not be held liable to any participants for any fraud committed by any third party, nor in an event beyond its control.
16. Novartis decisions will be final in all circumstances and no correspondence will be entered into.
17. These Terms and Conditions are subject to the Laws of New York State, USA and courts sitting in New York city.
